Copyright Law and Derivative Works Regulating Creativity

Copyright Law and Derivative Works Regulating Creativity

Copyright law regulates creativity. It affects the way people create works of authorship ex-ante and affects the status of works of authorship significantly ex-post. But does copyright law really understand creativity? Should legal theories alone inform our regulation of the creative process? This book views copyright law as a law of creativity. It asks whether copyright law understands authorship as other creativity studies fields do. It considers whether copyright law should incorporate non-legal theories and if so how it should be adjusted in their light. For this purpose the book focuses on one of the many rights that copyright law regulates – the right to make a derivative work. A work is considered derivative when it is based on one or more preexisting works. Today the owner of a work of authorship has the exclusive right to make derivative works based on her original work or to allow others to do so. The book suggests a new way to think about both the right the tension and copyright law at large. It proposes relying on non-legal fields like cognitive psychology and genre theories and offers new legal-theoretical justifications for the right to make derivative works. As the first book to consider the intersection between copyright law creativity and derivative works this will be a valuable resource for students scholars and practitioners interested in intellectual property and copyright law. | Copyright Law and Derivative Works Regulating Creativity

The Alchemical Mercurius Esoteric symbol of Jung’s life and works

The Alchemical Mercurius Esoteric symbol of Jung’s life and works

The figure of the alchemical Mercurius features ubiquitously and radically in Jung’s later works but despite this there has been little research concerning Mercurius in Jungian studies to date. In this book Mathew Mather explores the figure of the alchemical Mercurius and contextualises and clarifies its significance in Jung’s life and works. Placing the alchemical Mercurius as a central concern reveals a Jungian interpretation in which the grail legend alchemy and precessional astrology as three thematic threads converge. In such a treatment Jung’s belief in the dawning of a new platonic month emerges as a central consideration and an esoteric perspective on Jung’s life and works is brought more fully to light constructing a life-myth interpretation. The book is comprised of three parts: Aurea Catena: locating the figure of the alchemical Mercurius within the Western esoteric tradition Daimonic Encounter: the relevance of this figure in Jung’s personal life Magnum Opus: Jung’s portrayal of this figure in key texts such as Synchronicity Aion Mysterium Coniunctionis; and Emma Jung and von Franz’s The Grail Legend. The Alchemical Mercurius is a unique contribution to analytical psychology substantially revealing ‘esoteric Jung’ and providing valuable perspectives on the theme of his myth for our times. The book will appeal to researchers and academics in the field of analytical psychology as well as postgraduate students. | The Alchemical Mercurius Esoteric symbol of Jung’s life and works

Xenophon’s Socratic Works

Xenophon’s Socratic Works

Xenophon’s Socratic Works demonstrates that Xenophon a student of Socrates military man and man of letters is an indispensable source for our understanding of the life and philosophy of Socrates. David M. Johnson restores Xenophon’s most ambitious Socratic work the Memorabilia (Socratic Recollections) to its original literary context enabling readers to experience it as Xenophon’s original audience would have rather than as a pale imitation of Platonic dialogue. He shows that the Memorabilia together with Xenophon’s Apology provides us with our best evidence for the trial of Socrates and a comprehensive and convincing refutation of the historical charges against Socrates. Johnson’s account of Socrates’ moral psychology shows how Xenophon’s emphasis on control of the passions can be reconciled with the intellectualism normally attributed to Socrates. Chapters on Xenophon’s Symposium and Oeconomicus (Estate Manager) reveal how Xenophon used all the literary tools of Socratic dialogue to defend Socratic sexual morality (Symposium) and debate the merits and limits of conventional elite values (Oeconomicus). Throughout the book Johnson argues that Xenophon’s portrait of Socrates is rich and coherent and largely compatible with the better-known portrait of Socrates in Plato. Xenophon aimed not to provide a rival portrait of Socrates Johnson shows but to supplement and clarify what others had said about Socrates. Xenophon’s Socratic Works thus provides readers with a far firmer basis for reconstruction of the trial of Socrates a key moment in the history of Athenian democracy and for our understanding of Socrates’ seminal impact on Greek philosophy. This volume introduces Xenophon’s Socratic works to a wide range of readers from undergraduate students encountering Socrates or ancient philosophy for the first time to scholars with interests in Socrates or ancient philosophy more broadly. It is also an important resource for readers interested in Socratic dialogue as a literary form the trial of Socrates Greek sexual morality (the central topic of Xenophon’s Symposium) or Greek social history (for which the Oeconomicus is a key text).

A New Dictionary of Music

A New Dictionary of Music

What is a fugue? What is the difference between a saxophone and a saxhorn? Who besides Puccini wrote an opera called La Boheme? In what year was the National Broadcasting Company Orchestra formed under Arturo Toscanini's direction? These and thousands of similar questions are answered in this comprehensive dictionary that remains unrivaled as a single-volume summary. A New Dictionary of Music is a basic reference work for anyone interested in music whether performer or layman. It covers orchestral solo choral and chamber music opera and (in its musical aspects) the ballet. There are entries for composers (with biographies and details of compositions); works well known by their titles such as operas and symphonic poems; orchestras performers and conductors of importance today; musical instruments (including those of the dance and brass bands); and technical terms. English names and terms are used whenever possible but foreign terms in general use are cross-referenced. Particular importance has been attached to bringing the reader abreast of new musical developments. The composers and musical works chosen were those most likely to be encountered. Where an opera is given an entry a brief explanation of the title follows. Similarly explication is provided for other works bearing literary or otherwise allusive titles. Among performers and conductors only the following are included: those who although dead continue to be prominent through recorded performances (e. g. Gigli); the highest-ranking international artists of today plus a very few apparently on the verge of attaining that rank; and a few who though not necessarily at the very head of their profession are closely associated with composers in bringing out new works or are conductors in charge of important orchestras.

Teacher Evaluation Policies and Practices in Japan How performativity works in schools

Teacher Evaluation Policies and Practices in Japan How performativity works in schools

This book explores the impacts of the introduction of new teacher evaluation policies on teachers and head teachers in Japan particularly that of producing and reinforcing mutual policing relations among teachers and the destabilisation of their identities. It is timely given the big surge of interest world-wide in measuring and developing teachers’ quality to ensure better learning outcomes. As in many other countries teachers in Japan have to account for their performance and competence in new ways. This book focuses on the nature and impact of these new accountabilities by drawing on data from a national survey and in-depth interviews with a sample of teachers and head teachers as it surveys: New teacher evaluation policies Theories of teacher evaluation and performativity Views on the new teacher evaluation policies The enactment of the new teacher evaluation policies The quantitative data is used to show how teachers experience and perceive the new teacher evaluation policies and practices and the qualitative data is used to discuss the depth of analysis required to look at the nature of performativity. This book will be a valued addition to the research base upon which both policy makers and practitioners across the nations can draw for the improvement of teacher evaluation as a means of professional development and accountability. | Teacher Evaluation Policies and Practices in Japan How performativity works in schools
